1. Service Description & Third-Party API Disclaimer

1.1 TikTool Live provides a managed third-party API that enables developers to access real-time TikTok LIVE broadcast telemetry, including chat messages, virtual gifts, viewer counts, and other engagement metrics.

1.2 TikTool Live is not affiliated with, endorsed by, or sponsored by TikTok or ByteDance Ltd. "TikTok" is a trademark of ByteDance Ltd. All TikTok-related trademarks and content are the property of their respective owners.

1.3 TikTok does not offer a native, public API for TikTok LIVE stream data. Our Service processes publicly accessible broadcast data to deliver structured event telemetry. This data pipeline is independently operated and not officially supported by TikTok.

1.4 TikTok may suppress, modify, block, or remove access to its endpoints at any time without notice. When this occurs, TikTool Live will attempt to update its systems to restore access, but there is absolutely no guarantee of success or timeline. You acknowledge and accept that the Service may become temporarily or permanently unavailable due to actions taken by TikTok.

1.5 This Service relies on access to TikTok's platform. The Service may be interrupted, modified, or discontinued at any time without notice if TikTok restricts, blocks, or otherwise limits access to its platform or data. TikTool Live assumes no liability for any such interruptions.

2. Account Terms

2.1 Your user account may only be used by one organization. A single account shared by multiple organizations is not permitted.

2.2 You are responsible for maintaining the security of your username, password, and API keys. TikTool Live cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

2.3 You must not use the Service to carry on any illegal or unauthorized activities, including but not limited to copyright or trademark infringement, harassment, spam, or abuse of TikTok or its creators.

2.4 You may not violate TikTok's intellectual property rights or those of TikTok creators. You will be banned from the Service if you are reported to have engaged in such violations.

3. Multi-Account Policy & Abuse Prevention

3.1 You may not create multiple accounts to circumvent usage limits, rate limits, or other restrictions. Each individual or organization is entitled to one account unless explicitly authorized by TikTool Live.

3.2 We monitor account creation patterns including IP addresses, email addresses (including normalized variations), and browser fingerprints. Creating accounts with email aliases (e.g., using "+" addressing such as [email protected]) or dot variations of Gmail addresses to obtain additional free API keys is a violation of these terms.

3.3 If our systems detect potential multi-account abuse, you will be presented with a warning. Continued creation of duplicate accounts after receiving this warning may result in:

  (a) Suspension or termination of all associated accounts;
  (b) Revocation of all API keys across associated accounts;
  (c) A permanent ban from the Service.

3.4 Accounts with active paid subscriptions are permitted to have multiple API keys as provided by their subscription tier. The multi-account restriction applies specifically to creating separate accounts to obtain additional free-tier access.

3.5 We reserve the right to flag, restrict, or terminate any accounts that we believe, in our sole discretion, are being used to abuse the Service.

4. Free Tier & API Key Access

4.1 The free tier provides access to all API endpoints with lower rate limits and daily request quotas. Free tier access is intended for personal projects, learning, and testing purposes.

4.2 Free tier usage is subject to limits including but not limited to: daily request caps, per-minute rate limits, WebSocket connection limits, and bulk check limits. These limits may be adjusted at any time without notice.

4.3 If you require higher limits for production applications, you must subscribe to a paid tier (Pro or Ultra). Using multiple free accounts to build production applications is a violation of these terms.

4.4 TikTool Live reserves the right to modify, restrict, or remove free tier access at any time without notice.

5. Payment and Refunds

5.1 Beyond the free tier limits, you may be required to enter a valid payment method to access premium features or higher usage limits.

5.2 Subscriptions are billed in advance on a recurring basis (weekly, monthly, or yearly). You may cancel at any time, and your subscription will continue until the end of the current billing period.

5.3 We offer a 7-day money-back guarantee on initial subscriptions. Beyond this period, there will be no refunds for payments of usage charges unless otherwise required by applicable law.

5.4 In the event that TikTok blocks or restricts access to its platform, causing the Service to become temporarily or permanently unavailable, you may not be entitled to a refund for the remaining period of your subscription. TikTool Live will make reasonable efforts to restore service but cannot guarantee any timeline or outcome.

6. Cancellation and Termination

6.1 You are solely responsible for properly canceling your account. An email or phone request to cancel an account is not considered cancellation. You can cancel your subscription at any time through the billing portal in your dashboard.

6.2 If you delete your account, all content and data associated with that account will be immediately deleted from the Service. This information cannot be recovered once deleted.

6.3 TikTool Live, in its sole discretion, has the right to suspend or terminate any account at any time, for any reason or no reason, including but not limited to suspected abuse, violation of these terms, or at the request of law enforcement.

6.4 TikTool Live reserves the right to refuse service to anyone for any reason at any time.

7. Copyright and Content Ownership

7.1 We claim no intellectual property rights over the material you provide to the Service. Your materials remain yours.

7.2 You shall defend TikTool Live against any claim, demand, suit, or proceeding made or brought against TikTool Live alleging that your content, or your use of the Service, infringes or misappropriates the intellectual property rights of a third party or violates applicable laws.

7.3 You shall indemnify TikTool Live for any damages finally awarded against, and for reasonable attorney's fees incurred by, TikTool Live in connection with any such claim.

8. Privacy

8.1 We collect information used solely to provide and improve the Service, including but not limited to email addresses, IP addresses, usage metrics, and anti-abuse data.

8.2 We will not sell any personally identifiable information to third parties for profit.

8.3 We may disclose personally identifiable information under special circumstances, such as to comply with subpoenas or other legal process.

9. Disclaimer of Warranties

9.1 You use the Service at your own risk. The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 TikTool Live does not guarantee the accuracy, completeness, reliability, or availability of any data provided through the Service.

9.3 TikTool Live is not responsible for any actions taken by TikTok that may affect the availability of this Service, including but not limited to API changes, endpoint suppression, rate limiting, IP bans, or platform policy changes.

9.4 TikTool Live makes no guarantee that the Service will be available at any particular time or for any particular duration. The Service may be interrupted, degraded, or discontinued at any time due to factors including but not limited to: TikTok platform changes, infrastructure issues, maintenance, or business decisions.

9.5 You acknowledge that the Service depends on a third-party integration with TikTok's platform and that this integration may fail, break, or become permanently unavailable without any fault on the part of TikTool Live.

10. Limitation of Liability

10.1 In no event shall TikTool Live, its operators, directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, business opportunities, revenue, or other intangible losses resulting from:

  (a) Your use of or inability to use the Service;
  (b) TikTok blocking, restricting, or modifying access to its platform;
  (c) Unauthorized access to your data or API keys;
  (d) Any bugs, errors, or inaccuracies in the Service;
  (e) Service interruptions, downtime, or discontinuation;
  (f) Any third-party conduct or content accessed through the Service.

10.2 TikTool Live's total aggregate liability for all claims shall not exceed the lesser of: (a) the amount you paid to TikTool Live in the three (3) months preceding the claim, or (b) one hundred US dollars ($100).

10.3 You expressly waive any claim for damages arising from the interruption, modification, or discontinuation of the Service due to TikTok platform changes or any other reason beyond TikTool Live's control.

11. Rate Limiting & Fair Use

11.1 Rate limits and daily request quotas are subject to change at any time, without notice. Exceeding rate limits may result in temporary or permanent suspension of your account or API key.

11.2 Premium tier subscribers receive higher rate limits, priority routing, and dedicated support. These benefits are subject to fair use and may be adjusted if we determine that usage patterns are abusive or adversely affecting other users.

12. Indemnification

12.1 You agree to indemnify and hold harmless TikTool Live and its operators from any claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property right; or (d) any claim that your use of the Service caused damage to a third party.

13. General Conditions

13.1 You agree not to reproduce, duplicate, modify, sell, or resell the Service without express written permission from TikTool Live.

13.2 Do not tamper with or attempt unauthorized access to the Service, or falsely imply that you are associated with TikTool Live or any of its services.

13.3 These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TikTool Live operates, without regard to its conflict of law provisions.

13.4 The failure of TikTool Live to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
